oem versions upgrade (help)

5 month ago, I purchased a computer that came with windows
xp ( no other software was also included ). I donwloaded
service pack 1 and it installed properly. I also use
windows update regularly. I've installed some software on
this machine ( all legal software ).
I went back to the store where I bought my machine and I
found out that the store was closed. I also found that
that store had been selling computers with illegal
versions of windows. So, I'm assuming my version of
windows is illegal as well.
So I want to buy my own original copy of windows Xp pro
because I don't want to have illegal sofware on my
computer.
I checked the prices and there atre two versions retail
for around 390$ and OEM for around 150$ ( all original).
Since the rest of the software on my PC is all legal, I
don't want to format.
Can I use the OEM CD that I'm going to buy today or
tomorrow at max, to do an upgrade installation from the
current xp pro(illegal volume lisence) to the xp pro OEM
(original)?

No. An OEM version can only be installed on a "clean"
drive/partition. Once installed, it can be used to do repair
installations but it can't be used to do upgrades from other
versions of Windows.

If you've been able to update, then your license is probably legal.
