modem in use

I am using wixfax pro 10.0 to recieve incomming faxes which was working fine.
Now when i try to active the "recieve automatically" feature i get an error
message that says com3 is already open. I have searched and can find nothing
that is using the modem or the com port.
In the device manager i shows the modem and its port is com 3 but when i try
to query the modem on the diagnostics tab i get the message modem is in use
by another application.
I have a lucent win modem attached to com 3 and have upgraded the driver
from version 6.04 to 8.30 which change the modem name to "AGERE"
In the winfax setup for modems there is a test all ports button and it lists
com 3 and reports modem found. it also show on the properties tab for the
"agere win modem" that the port is TAPI but the drop down menu has only TAPI
and com 1 as choices.
Is the winfax program at fault here or is there some application that i
can't seem to find using the modem and not allowing winfax to access it?
Any help would be greatly appreciated.

I also have a Lucent WinModem, AKA an Agere PCI Soft Modem
I had a similar problem when using the 8.30 driver. The modem was
essentially useless with that driver; I always got a "device already
in use" error message. It had me tearing my hair out. Install the
driver from the i307 directory on the provided CD, or do a Google
search for "Lucent i307" and try installing that driver. Just run the
setup.exe. Remove your current driver first. Worked for me.

Good luck.
