EULA issues when distributing images electronically?

We are getting ready to distribute our image electronically by way of a
secured website. We'll post the bootable thumb drive images and the CF
drive images and related documentation. Customers and our support engineers
can download the images and create a bootable thumb drive that can be used
to load a new image onto the CF of our embedded device. Some people here
are convinced that we must display the EULA and get customer acceptance
before downloading any XPe images. I'm not a legal expert in any way, but I
don't think we need to deal with the EULA and licensing. The license is the
sticker on the embedded device.

Opinions?

This would be a question for your embedded distributor to push to MS. I
would suggest contacting them for answers.

If I remember correctly, if you are replacing the image via SDI, or such,
you should be OK... they were licensed originally and all you are doing is
replacing the image...

Yeah, the legal beagles are chasing down all the issues. I was just
checking with the group to see if anyone had found any interesting issues.
We really don't want the customers or support engineers having to deal with
EULA issues.

I don't think you will have problems... Once the image is licensed, you
should be good.
