Does anyone know if this issue has been resolved and released? I have the
latest SP and it still seems to be a problem

It was just released/implemented, the ADO.Net Entity Framework, with VS
2008. It's not a mature ORM solution like nHibernate that has been out for
many years. EF has got some maturing to do in areas. So, you might expect
that some things will not be in EF until subsequent releases of VS, at least
that's what I have been told.
