DirectX 9.0b causing refresh rates problems

Windows and DirectX have a history of locking refresh
rates at 60hz, for no reason that Microsoft has ever made
clear to the end user. However, DirectX 9.0b has been the
first release of the software so far, in my experience,
which renders 3rd party refresh rate "fixes" useless. I am
now suffering from headaches and eye strain when I play
any game software for more than 20 minutes. If I change
the registry to force windows to select the correct
refresh rate, a lot of software (Star Wars Galaxies for
example) generates errors and will not run. Please could
somebody;

(1) provide a "work around" or "fix" for this feature of
DirectX / Windows that works with DirectX 9.0b

(2) provide a reason why this feature is consistantly
included in Microsoft software, when it causes pain and
discomfort for some users of it's software.

I do not wish to sound angered or sarcastic in this post,
but it is an issue for me which re-occurs occasionally
when I upgrade DirectX or my VGA drivers.
