2000 terminal services licenses

We have had a 2000 application server and a license server
on the same box. We want to move the application to a
different box and upgrade the OS to 2003. My questions are

1. Can we leave the license server on a 2000 os and on a
separate box?

2. Doesn't xp operating system (home and professional)
have a built in terminal services licese? If so, is it
good in both 2000 and 2003?

If you upgrade the TS to 2003, you also need a 2003 Licensing Server,
since a W2K LS cannot handle 2003 TS CALs (the other way around is
OK). A 2003 LS does not need to run on a DC anymore.

W2K Pro and XP Pro clients get a free TS CAL when they connect to a
W2K TS, but not to a 2003 TS. But you might be entitled to a free
Transition TS CAL for you XP Pro clients, if you owned them before 24
april 2003. Check the details here:
