Is it "legal" for a service person to install an Academic
priced version of Windows XP on a system even if no proof
was provided?

Whether a law was broken is for police and lawyers to discuss. It
probably is not in conformance with the license agreement, which is an
agreement between you and Microsoft.

I don't know about the actual hard legalities but I personally refuse to
install any item of software in the couse of my work without knowing for
sure to my satisfaction that a licence is available. It's a matter of
professional stanadards of behaviour imho.

Is the Academic version purchased legally? Actually a good question is does
Microsoft require proof.

He said that he had stated to my boss that it was an
Academic version. My boss has no idea what that means. I
asked if he explained and he said "no". I know every site
that I have checked out software states that proof will be
required to purchase Academic software. He never asked
for any proof.

I feel the same way, that is why I would like to get this
cleared up. The service guy claims to have told my boss
that there was an academic version, my boss said "do
what's cheapest". My boss had no idea what an Academic
version was. He did not ask for any proof for us to
purchase this version....He sold it to us unknowingly....

Well there are strict conditions to meet to be using academic licenced
software, and I'd have to say that if you have to ask you almost certainly
don't meet them. You can't certainly can't use it for a business.
