I have taken the original hd from my old computer and put it in a newer one
and have installed Vista on it.

What I want to do, is install a smaller hd into the old computer to run xp
on it. Basically, the XP will be on the same machine, just a different hd.
Can I do that without a problem from the EULA? ( I will have to install it
over 98SE)

Was XP on the HD that you moved and then "upgraded" to Vista using an
upgrade version which needed XP to upgrade??.............then the answer
would no
Or did you use a Retail Version of Vista and did a clean install...no more
XP on the moved drive?? then the answer would be yes

If the copy of XP was used as the qualifying OS to use an upgrade edition of
Vista, then no you can't. The license for that copy of XP is subsumed into
the Vista upgrade license, and cannot be installed while Vista is installed.

Not to muddy the waters to much but also, if the copy of XP you had was OEM,
then by it's license it could not be moved to the other computer. It could
be used as the qualifying OS to use an upgrade edition of Vista on the old
computer, but it cannot be moved to a new computer.

If XP was retail then that's fine, it can be moved, but as I said above it
can't be installed anywhere else while Vista is installed.
