Is it legal if you have removed it from your computer ( I had Home and
purchased XP Pro ) ?

If it is illegal can you give it to someone and will they be able to get it
activated ?

Is it part of the terms and conditions ?

Yes, if the version of Windows in your hands is a retail version. You remove
the installed copy of Windows from the computer it is installed on now, then
hand the Windows disc and material to the buyer.

No, if the version of Windows is OEM, you may not sell the original OEM
software i.e. XP HOME. *** However, you may revert your computer to the Home
verision (i.e. uninstall the Pro upgrade) and then sell the Pro upgrade off
... you should hand the XP Pro disc and material to the buyer.***

One additional point Will may have upgraded from Home to Professional, and
now wants to sell his copy of Home. If he used an Upgrade version of XP
Professional, he may not sell or give away the XP Home copy even if it's a
Retail version. When you do use an Upgrade version, the product you upgraded
from is bound to the license for the new product.
