Access queries failing after transfer to XP

I hope this is a relevant place for this query.
I have an Access application running on four machines. Some of these have
been replaced and XP is the operating system.
The application works on some XP machines but fails on others in one
particular form. The problem has been isolated to a query using a comparison
'Is Null or > Date()'.
Remove the Date() function and the query works.
The application is written in Access 97 because that is the oldest version
still being used in the operating area.

I would be grateful for any indication as to where to look to resolve this.
