Someone else can tell you, but I think there is a third party that can
mediate in things like this (not sure if you have to pay).

how about contacting them and asking them to mediate?
The first thing I would do right now is go to namecheap.com and backorder
the domain just in case .. it will cost a little but it's much cheaper than
one of those iditotic search companies picking it up .... then when it comes
free it will be yours... if you don't someone else will buy just as a matter
of course belive me.
Did you try his email address in the request password feature?
I suppose the password was passed on verbally and he did not write it down?
Is the domain a co.uk ? if so he should have got a certificate if his
address was used?
I don't know all the in's and outs on domains but if you want to email me
off group please do so. You can always find me via my sig line.
I take you don't host the site with them? (always a GOOD thing)

I've forgotten my password. How can I find out what it is?
This depends on which password you have forgotten.
If it is your (aq) customer account password, then you can retrieve it by
entering a domain name associated with your account on the login screen. The
details of your account will be sent via email to the address(es) on your
account.
If you have forgotten your password for email/webspace or other services,
then raise a support ticket requesting the passwords you require.
