I have gotten 2 hard drives from dell and none of them have worked for longer then 2 weeks.

I't getting frustrating and they are looking for a payment but i refuse to pay for something i can't use.

Could be a faulty batch that they had sent into them. Have you tried reinstalling windows? To get your data back I would download this
http://www.ubuntu.com/getubuntu/download then buirn it with power iso and boot from the cd install it or run it from the cd this will then allow you to copy all your pics, music, docs. To CD, DVD or pen drive then you can go ahead with the reinstall with windows. It might also be worth checking with dell to see if they can give you any sort of benchmark tool to test the drive, or if you know what the maker of the drve is you could go to there site and downlaod the tool from there and test the drive.
Edit: I have found a step by step guide on how to recover files using Ubuntu.
Here As mentiond before send the laptop back if its new. But back up the data frist.
