why is dec 30 2007 showing up in week 53 instead of week 1 of the new year.

Because it is last year!
Maybe you can build a business rules to get around the calendar.
What would your rule make as being in the new year if 31 Dec was on a
Friday? Where would you draw the line - at Wednesday?
