An easier option might be to state on the form itself
that by pressing submit the user abides by the terms &
conditions- which can also be a link to an html page of
said conditions

you could have some text

Thought Of that/Trying to make sure that all sides are covered legally so I threw In an inline frame with the terms available
that takes up less space so one can scroll then an option yes or no agreement under it with a validatio
