cant get Infrared reciever to use free com port

i have a creative labs infrared reciever and remote control. it hooks up to the serial port. i loaded the drivers. i made sure the serial port was using a free com port ( com3) . the reciever will not work. when i set it to use com3, it says it cannot. it allows me to select com5, even though com5 is used by the modem. it still does not work on com5. what could be wrong??
