Arachnophilia theft

Hello newsgroup! Some of you may know me as the author of Arachnophilia and
other free programs available at http://www.arachnoid.com.

Today I discovered someone was so deeply offended by my giving away my
programs for free, that he has been selling one of them for over a year,
at:

http://the-info-resource.com/catalog/product_info.php?
manufacturers_id=15&products_id=144

(put this URL on one line to visit the site)

Is this really a listing of my free program Arachnophilia? Yes.

Is this Web site making people pay for it? Also yes.

Did the page designer misspell the name of my program to make it harder for
me to find it? Yes, I think so.

Did that work? Only for a while.

Is all this illegal? Absolutely.

Someone is bound to ask, "if Arachnophilia is free, how can it be called
'theft'?" Well, if someone tries to sell a free program, that's definitely
theft.

The appropriate legal authorities have been alerted. Stay tuned.

Hi Paul,
I doubt they are offended...more likely simply a thief hoping to gain from
others. I see that it is a go daddy domain and the registrant is from a
town where I have a brother living and only a couple hours from me. It's a
small world indeed.

Good luck with your pursuit. It's a sad affair when people steal from
others. I have no tolerance for thieves.

http://the-info-resource.com/ has "Independent Booksellers by
www.Chrislands.com" at the bottom of the page. Is it possible to tell if
they are being hosted by Chrislands?

http://www.chrislands.com/shops/faq.php

# Q10: Are there any restrictions on what I can sell?
A: You cannot use this service to engage in the selling and/or
distribution of specific types of goods/services, such as:

# Products and services that infringe on copyrighted property of others

also. . .

I know many booksellers who have Chrisland sites. I'm sure they would
not be happy to hear they're in bad company *if* indeed that is the case.

humm, It looks like from a "whois" that the domain name is registered
through Go Daddy. I don't know if that means for sure that GoDaddy also
hosts the domain. But I don't see any other info about being hosted by
someone else.

The banner at the bottom of the front page you're referring to looks to be
a plain old web ring banner. Likely the domain owner has an account with
Chrislands as they are selling books, but I'm not sure if Chrislands
actually hosts the domain. I don't know the ins and outs of a whois query.
If I were Paul, I would contact GoDaddy and the registrant and my lawyer.
(which he probably has)

Already a "product not found" notice shows up where that was.

They're not; they just joined the Chrislands.com webring, which includes
a lot of sites not otherwise associated with Chrislands

yep, it's been removed, along with a couple of reviews asking why they were
selling freeware

Paul,

Try contact (complain to) godaddy.com. They've reacted when a
domain registered through them has violated the TOS.

Then it isn't free. You say there are restrictions w/o saying what they
are.

You lose.

He retains his copyright. Restrictions on stealing copyrighted works
are clear, and they are in place unless he explicitly waives them.
