Annoying mouse problem, software or hardware?

I've got a laptop with a touchpad mouse built in and when
I scroll the cursor over certain task buttons and links
they will activate whether I click on them or not. This
drives me crazy...if I want to execute a certain task or
go open a link I'd much prefer to do it myself!

Any ideas? Is this a software problem?
