Does the Excel Chart automation use the ¾ high rule?

What does that mean? If you are using automation you can make the
chart dimensions (well, that of an embedded chart anyway) anything you
want.

If you mean the dimensions of the default chart that XL creates, why
not check the ratio of the height to the width yourself? Of course,
you will have to decide what element to check: the chartobject, the
chartarea, or the plotarea.
